:: IS THE PERSONS WITH DISABILITIES ACT IN FORCE?
1. The Persons with Disabilities Act came into
force on 16th June, 2004. Sections 22 (covered under paragraph
19), 23 (covered under paragraph 20), 24 (covered under paragraph
21), 35(1), 35(2) (covered under paragraph 28), 39 and 40 of the
Act, however, are not yet in force and will come into force when
the Minister responsible for matters to do with disabilities publishes
a notice in the Gazette bringing the provisions into force.
Parliament, when passing the Act, allowed the
Minister responsible for its implementation to bring the Act into
force in stages. Except for the provisions indicated above, the
Act is in force. The effect is that only those provisions that
are in force have got any legal effect. The rest do not and will
only do so once the Minister brings them into force.
