:: Divorce Matters
INTRODUCTION
The parties to divorce proceeding are referred to as:
.Petitioner- The party filing for divorce.
.Respondent- The party against whom divorce
is sought.
The following requirments must be met before a person can file
for divorce:
.The parties must be domiciled in Kenya.
.The divorce petition must be brought three
years after celebration of marriage.
.Leave may be granted by the court to file the
divorce petition before the expiry of 3 yaers in exceptional cases.
THE DIVORCE PROCEEDINDS
The divorce petition must the following contents:
.Place and date of marriage.
.The names and dates of birth of the children,
if any.
.The domicilies of the parties and their occupations.
.Details of any related previous proceedings.
.The matrimonial offences alleged and the particulars
thereof.
.The prayers sought.
The grounds for divorce are as defined in the Matrimonial Causes
Act, Sections 8 and 22. They are as follows:
.Adultery.
.Cruelty.
.Desertion.
.Unsoundness of mind.
.Rape/Sodomy/Bestialty.
.Presumption of death.
