:: Margistrate's Court
INTRODUCTION
. The Magistrates' Courts are governed by the provisions of
the Magistrates' Courts Act (Cap.10)
. They are also referred to as Subordinate Courts.
HIERARCHY
. The hierachical structure of the magistrates's Courts is as
follows:
1. Chief Magistrate,
2. Senior Principal Magistrate,
3. Principal Magistrate,
4. Senior Resident Magistrate,
5. Resident Magistrate
6. District Magistrate.
INSTITUTION OF CRIMINAL PRCEEDINGS
.The criminal process is undertaken by the State,
which is the prosecutor.
.Criminal cases are initivated by a complaint being lodged with
the police station which is recorded in the Occurrence Book.
.The decision to file a case depends on the information in the
Occurence Book from which the police can investigate and determine
what kind of offence has been committed.
.Once the police decide what kind of offence has been committed,
they draw a charge sheet.
.The police can then proceed and make an arrest of the suspect(s).
. The suspect(s) are then produced in court to enter a plea in
respect of the charges proffered againts them.
The case is then heard and determined by the courts.
